Obligatory Motor Third Party Liability of land vehicle owners (MTPL) is insured in accordance with the Law of Ukraine No. 1961-IV “On obligatory insurance of Motor Third Party Liability of owners of land vehicles” of 01.07.04 with subsequent alterations and amendments.
MTPL is liability insurance for damage that can be caused to other people (their life, health and/or property) by Insurant’s vehicle.
In case the vehicle driver commits a road traffic accident the other participant of the accident (the damaged one) will receive the reimbursement. The driver and the owner of the vehicle that caused the accident do not receive the reimbursement but insurance company assumes their responsibility to repay the loss to the damaged party.
Obligatory liability limit:
- for damage caused to the property of the victim – UAH 50 000 per one damaged party (if there are more than 5 damaged parties the five-time amount of liability limit is divided between all parties);
- for damage caused to life and\or health – up to UAH 100 000 per each damaged party.
In case of the accident involving only insured vehicles the drivers have the right to draw up the common statement («Europrotocol») without involving police provided:
- there are no injured (dead) people;
- the drivers of these vehicles agree upon the circumstances of the accident;
- the drivers do not have the signs of alcohol, drug or other intoxication and are not under the influence of medicines reducing attention or reaction speed.
Only those participants of the accident who (both) have concluded the MTPL Contracts after 18.09.11 have the right to the simplified documentation of the accident using the “Europrotocol”.
In this case after drawing up the statement (“Europrotocol”) drivers of the vehicles have the right to leave the place of the accident and are relived of the obligation to inform State Motor Inspection of Interior Ministry of Ukraine on its occurrence.
Pending the introduction of alterations by the authorized body (Derzhfinposluh) the maximum sum that can be settled under “Europrotocol” is UAH 10 000.
MTPL Contracts are concluded on the principle “one car – any driver” for the period of 1 year.
Concluding MTPL contracts for the period less than 1 year but no less than 15 days is allowed exceptionally to the following vehicles:
- unregistered – pending their registration;
- temporary unregistered – pending their permanent registration;
- registered on the territory of foreign countries – at the time of their stay on the territory of Ukraine.
Contracts insuring Motor Third Party Liability of owners of land vehicles subject to obligatory technical control (OTC) are concluded provided these vehicles passed OTC and were recognized as technically sound.
MTPL contracts for vehicles subject to OTC are concluded for the period that does not exceed the period to the next OTC.
The following categories are exonerated from obligatory MTPL insurance:
- combatants and disabled veterans as defined by law, handicapped people of group I who personally drive the vehicles owned by them;
- people driving the vehicle owned by the handicapped person of group I in his presence. Losses caused by these citizens driving their own car are reimbursed by MTIBU.
Insurance premium for one MTPL contract is reduced by 50% provided the Insurant is the citizen of Ukraine – combatant, handicapped person of group ІІ, person who was the victim of Chornobyl disaster assigned to the category I or II, retired and the insured vehicle has cubic capacity up to 2500 cc and is owned by this citizen.
According to article 21 of the Law of Ukraine “On obligatory insurance of Motor Third Party Liability of land vehicles owners” it is forbidden to use the vehicle on the territory of Ukraine without valid MTPL policy.
